Brothers arrested in drive-by that killed 14-year-old girl plead not guilty
The brothers accused in a drive-by shooting that killed a 14-year-old during a party in Las Cruces pleaded not guilty.
Julio Gutierrez-Barrera, 20, appeared in court Tuesday. He is the alleged shooter in the drive-by where Jocelyn Trujillo-Pierce died.
Gutierrez-Barrera was charged with murder, tampering with evidence and conspiracy to commit a felony.
He will remain in jail without bond.
His brother, 19-year-old Alonzo Barrera, was also charged in the murder. Barrera pleaded not guilty during his arraignment on Monday. He was charged with tampering with evidence and conspiracy to commit a felony. Barrera will also remain jailed.
Police said the brothers were at a party on the 1400 block of Monte Vista Avenue last month before they got into a fight with someone and left.
According to police, the brothers returned to the residence shortly after leaving, before Gutierrez-Barrera allegedly drove by, stopped in front of the residence, and fired three rounds from a 9 mm handgun toward the home where the party was happening, striking Trujillo-Pierce in the back of the head.
When interviewed by investigators, Alonzo said his brother wanted to go back to the party and find the person “who called him a (expletive).” Alonzo told investigators his brother racked a black semiautomatic Glock-type firearm to load a round into the chamber, according to court documents. Alonso said he tried to tell his brother to stop and not go through with what he was doing.
According to court documents, Alonzo told investigators when in the car with his brother, Gutierrez-Barrera pulled in front of the house reached over him from the driver’s seat and fired the gun.
Alonzo said they drove away and threw the gun out the window but then returned to pick it up. That’s when Alonzo said his brother got into a Chevrolet Camaro with a friend and had the gun in his hand, court documents say.
Police arrested the brothers Saturday at their apartment at the 1400 block of Telshor Boulevard and found the handgun believed to have been used in the shooting in the glove box of the Camaro at the friend’s house.
